Article 46 of the Labor Code mentions the days of National Holidays and consequently of mandatory rest, including National Holidays.

As a result, November 3, 5, 10 and 28 are not to be worked on November 3, 5, 10 and 28.

November 4, which corresponds to the patriotic symbols, is a working day; therefore, no surcharge is payable, unless overtime is worked.

 

Form of Payment

Personnel who work during any of the days of the National Holidays will receive, in addition to their salary, a surcharge of 150% per hour and will be entitled to another day of rest during the week.

In the event that the company does not grant the compensatory day, it will have to pay a surcharge of 50% per hour.

If the employee works during the day assigned as a compensatory day, he/she will receive a surcharge of 50% per hour.

 

Transfer of Rest

This year, November 5 falls on a Sunday and in accordance with Article 47 of the Labor Code, the day of rest will be moved to Monday, November 6.

If working on November 6, 2023, a surcharge of 50% per hour will be paid.
