Paternity leave

The employee with a pregnant wife and without a formal job will have paternity leave, therefore, in order to be dismissed, a previous permission from a judge is required.
The paternity leave will be for the duration of the pregnancy and up to one year after the baby is born.
The paternity leave is extinguished if the mother obtains a formal job.

The worker must provide a copy of the mother's identification card, a certificate of pregnancy, and a certificate from the Social Security Fund certifying that the mother is not formally employed.

Suspension of Contracts

The Pandemic as a cause for suspension of the effects of the contract is no longer valid and must now be supported by the economic impact on the company.

Benefit Calculation

Law 201 of February 2021 is no longer in effect and consequently, seniority premiums, severance payments and benefits are calculated taking into account the time of suspension of the contracts.

Telework

The alternative of teleworking remains in force, as long as it is in writing and by mutual agreement between the company and the employee. The obligations of confidentiality, participation in meetings by virtual means, remain in force.
